RAPE: MAGISTRATE COURT DISMISSES CASE AGAINST KADPOLY HOD

A Magistrate court in Kaduna has dismissed a case filed by one Mrs. Habibat A. Abubakar accusing her superior officer and Head of the Kaduna Polytechnic medical department, Mallam Abubakar Ya'u of raping her.

Mrs. Abubakar had dragged Ya'u to the magistrate court accusing him of forcing her into sexual relationship on 17th June 2011 in the accuse's office at about 12am that day.

Delivering the judgment yesterday, Magistrate, Joyce Kaka said, based on advice by the Kaduna State Ministry of Justice, the plaintiff failed to established her case due to the lack of evidence from her own side.

She further averred that the case was filed 10 days after the alleged incident. 'even the medical report shows that it was done ten days after though based on the medical test the woman sustained some bruises but these were not enough to establish the case and therefore the court has to dismiss the case due to the lack of merit.

Daily Sun recalled that on the 21st June 2011 Mrs. Abubakar resident at Anguwar Sunusi Kaduna reported that her boss Abubakar Ya'u allegedly raped her when she reported for duty at the Polytechnic Medical Centre.

According to her in her first report, Ya'u deceived her into his office under the pretence of giving her working materials but forcefully raped her without her consent, an offence contrary to section 283 of the panel code.
