IT FIRM DRAGS CHILEAN SOFTWARE PROVIDER TO COURT FOR BREACH OF CONTRACT

CHILEAN multi-national Information Technology (IT) company, Sonda S.A. of Teatinos 500, Santiago, Chile, has been dragged to a Lagos court by a Lagos-based IT firm - Enterprise Information Technology Limited (EIT) for breach of contract.

The plaintiff, in the suit filed on its behalf before the Lagos State High Court by a law firm- Adeniji Kazeem & Co, is seeking damages for the termination of its contract with Sonda S.A. and payment of outstanding sales and support commissions.

In its statement of claim, EIT accused Sonda S.A. of wrongful termination of its contract with the defendant and the refusal of the defendant to pay sales commissions for the business the Nigerian IT firm secured for Sonda S.A.

In also accused Sonda S.A. of unprofessional manner it implemented its Sonda AFP.net Pensions Software for the clients EIT secured for it in Nigeria.

Sonda S.A. had supplied a Pension Fund Administration Software that was alleged by clients of EIT to be sub-standard with several fundamental gaps and plagued with Spanish language problems. The problems associated with the software remained unresolved for over five years, thereby depriving the clients the expected return on the huge investments of millions of dollars in the Sonda AFP.net software. ? ?The suit, filed on June 21, 2010, has been fixed for hearing on Monday, January 10, 2011.
