Court Of Appeal Reinstates Okorie As Ebonyi State PDP Chairman

Describes Onu As Disrespectful And Desperate.

The Court of Appeal sitting in Abuja this morning, 23/5/22, has ordered the reinstatement of Mr. TooChukwu Okorie as Ebonyi State PDP chairman with effect from April 13, 2022. The ordered was part of the appealate courts ruling in a motion for stay of execution of the judgement of the Federal High Court, Abuja which had nullified the election of Mr. Okorie as Ebonyi State PDP chairman. The Appeal court judgement rightly stated that the order of the appellate Court takes effect from April 13, 2022 when the Notice of Appeal and motion for stay of proceedings was filed in court.

The Court of Appeal described the adventures of Mr. Silas Onu into assuming the office of the Chairman of Peoples Democratic Party ,PDP, Ebonyi State, as both an act of desperation and disrespectful conduct. The Appeal court, in ruling on a motion on Notice for stay of execution filed by the PDP and Mr. Tochukwu Okorie frowned at that conduct of Onu who was quick to assume the chairmanship of the state even when he was fully aware of the pendency of a motion for stay of execution of the judgement of the lower court.

Lawyers to Peoples Democratic Party, commenting on the decision stated that the implication of the judgment was that all actions taken by Silas Onu since 13/4/2022 remain null and void. This is because the court judgement directed all parties to maintain the status quo that existed before the delivery of the lower court's ruling on same April 13.

The judgement however maintained that the ruling stands, pending the hearing and final determination of the appeal by the appellants which is still pending before the Court of Appeal, against the judgement of His Lordship, Hon Justice A.R. Mohammed of the Federal High Court Abuja Division, delivered on the 13th day of April 2022.
