PRP Files Suit Praying Court To Restrain ODIEC From Conducting Local Government Election Unless And Until PRP Is Allowed To Participate In The Election
The Peoples Redemption Party (PRP), through its lawyer, Femi Aborisade, Esq., has filed an Originating Summons (Suit No. AK/68/2016) at the High Court of Ondo State praying the Court to determine the following questions:
1. WHETHER the Judgment of the Federal High Court,
delivered by Hon. Justice A. F. A. Ademola on 17th December 2015 is binding on all persons and authorities, including the Ondo State Independent Electoral Commission (ODIEC),Federal High Court, unless and until the said judgment is set aside?
2. WHETHER all persons and authorities, including the Ondo State Independent Electoral Commission (ODIEC), are bound to deal with the Peoples Redemption Party as a registered political party in Nigeria pursuant to the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015, unless and until the said judgment is set aside?
3. WHETHER the Ondo State Independent Electoral Commission (ODIEC) has the discretionary power to exclude the Peoples Redemption Party and its nominated candidates from participating in the 2016 Local Government Election at the backdrop of the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015, unless and until the said judgment is set aside?
The Party then prays the Court to grant the following reliefs:
1. A DECLARATION that the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015 is binding on all persons and authorities, including the Ondo State Independent Electoral Commission (ODIEC), unless and until the said judgment is set aside.
2. A DECLARATION that all persons and authorities, including the Ondo State Independent Electoral Commission (ODIEC), are bound to deal with the Peoples Redemption Party as a registered political party in Nigeria pursuant to the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015, unless and until the said judgment is set aside.
3. A DECLARATION that the Ondo State Independent Electoral Commission (ODIEC) has no discretionary power to exclude the Peoples Redemption Party and its nominated candidates in Ondo State from participating in the 2016 Local Government Election at the backdrop of the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015, unless and until the said judgment is set aside.
4. AN ORDER DIRECTING the Ondo State Independent Electoral Commission (ODIEC) to deal with the Peoples Redemption Party as a registered political party in Nigeria pursuant to the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015, unless and until the said judgment is set aside.
5. AN ORDER COMPELLING the Ondo State Independent Electoral Commission (ODIEC) to allow the Peoples Redemption Party and its nominated candidates to participate fully in the 2016 Local Government Election at the backdrop of the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015, unless and until the said judgment is set aside.
6. AN ORDER SETTING ASIDE the letter by the Ondo State Independent Electoral Commission (ODIEC) dated 24th February 2016 refusing to allow the Peoples Redemption Party to participate in the 2016 Local Government Election under the guise that INEC intends to appeal the judgment of the Federal High Court, and
7. AN ORDER OF PROHIBITION OR INJUNCTION RESTRAINING the Ondo State Independent Electoral Commission (ODIEC) from conducting the 2016 Local Government Election scheduled for 23rd April 2016 unless and until the Peoples Redemption Party (PRP) and its nominated candidates are allowed to fully participate in the said election, at the backdrop of the Judgment of the Federal High Court, Abuja Judicial Division delivered by Hon. Justice A. F. A. Ademola on 17th December 2015.
Meanwhile, no date has been fixed for the hearing of the Suit.
