Court Sacks Fintiri,  Orders swearing-in of Ngilari as Governor

A Federal High Court Wednesday in Abuja ordered that the former Deputy Governor of Adamawa State, Mr. Bala Ngilari, be sworn in as the governor of the state.

Ngilari had on July 1s, 2014 resigned as deputy governor, few hours before his boss, Governor Murtala Nyako was impeached by members of the House of Assembly led by Speaker Adamu Fintiri.

However, the court on Wednesday dismissed Ngilari's purported resignation as invalid, null and void. The court, presided by Justice Adeniyi Ademola,  held that by tendering his resignation to the Speaker, instead of the governor, the action breached the provisions of Sections 306(1), (2) and (5) of the 1999 Constitution.

Shortly after Nyako's impeachment, Ngilari, a lawyer and former member of the House of Representatives, approached a Federal High Court in Abuja, seeking an order compelling his swearing in as the governor of the state.

Ngilari had asked the court to declare as  illegal, null and void his letter of July 14, 2014 addressed to Speaker Fintiri.

Justice Ademola held that since Ngilari's letter was addressed whilst Nyako was still in office,  the same should have been tendered to the governor, and not the Speaker.

The judgment has overtaken a bye-election fixed for Saturday by the Independent National Electoral Commission ( INEC).
