PDP CANDIDATE IS TONY NWOYE NOT ANDY UBA

The attention of the Peoples Democratic Party (PDP) and the good of Anambra State have been drawn to the purported rumor currently circulating across the state that a Federal High court in Port-Harcourt declared Senator Andy Uba as the new PDP Candidate of the Peoples democratic Party in the forthcoming Gubernatorial election in Anambra State.

Let us get the facts right, Senator Andy Uba has been suspended by the National Working Committee of the PDP and a High court in Abuja upheld the Suspension of Senator Andy Uba, Chris Uba, Ejike Oguebego and three others on the ground that these individuals defrauded the Party by printing fake delegate cards which they used to organize an illegal congress in Anambra on the 24th of August, 2013. Therefore, It will be unfortunate for Andy Uba who is and remains suspended from PDP to champion media sympathy as he is prone to over these years to garner artificial support on the pages of newspapers and the online media with an intention of misinforming the good people of Anambra State.

Let us get the facts right again. Last month, Senator Andy Uba approached a Federal High Court in Port- Harcourt, praying the court to declare him as the PDP Candidate of Anambra state and exactly Seven days ago, the same court vacated its order which it has earlier given compelling INEC and the PDP to recognize Andy Uba as the candidate of the Party in Anambra state. The Court threw Andy Uba's plea to the gutters and asked him to go and work with Comrade Tony Nwoye who was the authentic Candidate that emerged at the Congress organized by the National Working Committee of the PDP

Senator Uba in his usual desperate moves asked to be joined in a suit by Ejike Oguebego obtained at a Federal High Court in Port-Harcourt where he filed a motion asking the Court to recognize him Ejike Oguebego as the PDP Chairman of Anambra State against Ken Emekayi. The Matter before the court was for THE RECOGNITION OF THE CHAIRMAN OF THE PARTY IN THE STATE AND NOT THE CANDIDATE OF THE PARTY AS A FEDERAL HIGH COURT IN ABUJA HAD ALREADY AFFIRMED COMRADE TONY NWOYE AS THE CANDIDATE OF THE PARTY IN ANAMBRA STATE.

In its judgment today, the court asked Ken Emekayi to maintain a Status quo while recognizing Ejike Oguebego as the Chairman of the Party in Anambra State. In a deliberate action, Senator Andy Uba and his followers started raising false reports and rumors that they have been declared the Candidate of the party in the state. Which Court gave them such rulings?

WE MUST GET IT RIGHT. Be not deceived; let us have a look at the Guidelines in Nigerian Electoral Act.

Electoral Act 2010(As Amended 29th December 2010) stipulates as follows

Nomination of Candidates by parties
Section 87 sub-section 1 stipulates that a political Party seeking to nominate a candidate for election under the act shall hold primaries for aspirants in all elective positions

Sub section 2 stipulates that for the nomination of candidates by political parties for the various elective positions shall be by direct or indirect primaries

In the case of Anambra State, the National Working Committee of the party adopted Indirect Primary

The electoral Act went on to stipulate in Section 87 sub-section 4 that for indirect Primary, a political party that adopts Indirect Primary for the choice of its candidate shall adopt the procedures outlined below

(b) In the case of nominations for the position of Governorship candidate political party shall, where they intend to sponsor candidates,

(i) Hold special congress in each of the Local Government Area of the state with delegates voting for each of the aspirant at the congress to be held at designated centers on specific dates

(ii) The aspirant with the highest number of votes at the end of the voting at the Governorship primary shall be declared the winner of the primaries of the party and the aspirant name shall be forwarded to the commission as the candidate of the party for the particular state

The Peoples Democratic Party (PDP) and the National Working Committee (NWC), followed all these steps before, during and after the Congress, complied with the above sections of our country's Electoral Act and eventually submitted the name of Comrade Tony Nwoye, the eventual winner of the Congress to INEC as stipulated by the Electoral act

WE MUST GET THE FACTS STRAIGHT. There was no where it was written in the PDP Constitution that it is the prerogative of the State Chairman to organize a Governorship Primary as Senator Andy Uba, Chris Uba and their likes in their deceitful and jingoist nature are busy dispensing to the public in such a deceitful manner

THE ORGAN THAT ORGANISES A GOVERNORSHIP PRIMARY IN ANY STATE ACCORDING TO THE CONSTITUTION OF THE PEOPLES DEMOCRATIC PARTY IS THE NATIONAL WORKING COMMITTEE OF THE PDP WHICH PRODUCED COMRADE TONY NWOYE ON THE 24TH OF AUGUST,2013 AND NOT STATE EXECUTIVES…Be not be deceived by the Uba brothers antics

The Court ruling of today was for the recognition of Ejike Oguebego and not Andy Uba.

TONY NWOYE REMAINS THE PDP CANDIDATE OF ANAMBRA STATE
