The Supreme Court Tuesday dismissed a suit seeking to stop President Goodluck Jonathan from seeking to re-new his mandate in the February 2015 presidential election.

Chief Justice of Nigeria, CJN, Justice Mahmud Mohammed, who led a five-man panel of judges struck out the appeal filed by a Peoples Democratic Party (PDP) chieftain, from Adamawa State, Dr. Umar Ardo.

The CJN held said the plaintiff brought a matter to the Supreme Court even when the same was pending before the Abuja Division of the Court of Appeal.

The CJN held that since the substantive suit challenging Jonathan's eligibility to seek re-election is pending before the court of appeal, it was an abuse of the judicial process to bring same before the Supreme Court.

He opined that the PDP chieftain lacked the locus-standi to make the Supreme Court to either take over the matter or compel the appeal court to join him (Ardo) as an interested party.
