FIRMS DRAG DIAMOND, ACCESS BANKS TO COURT OVER MAN'S DEATH

http://www.nigerianbestforum.com/blog/?attachment_id=122060 Cash-flow Abi Network Ltd., Cash-flow Abi Cooperative Society and their managing director, Philemon Ibrahim Gora, have dragged Diamond  and Access banks separately before an Abuja High Court for allegedly causing the death of a businessman (name withheld) because the banks failed to honour their several cheques.

The Plaintiffs averred that they have lost several business opportunities and incurred several liabilities because the banks denied them access to their accounts.

The Plaintiffs are demanding N1 billion from Diamond Bank and N200 million from Access Bank as general damages for breach of contract. In the suits filed by Max Ogar on their behalf, the plaintiffs stated that one of their 'business associates committed suicide recently in EbonyiState because of his funds that are tied down with the 1st and 2nd Plaintiffs owing to the action of the Defendants.' They averred that the only thing the Defendant's branches in Abuja have told them was that their accounts were on 'Post No Debit' (PND). 'Nobody has given the Plaintiffs any reason why their accounts are on PND.

'The Plaintiffs have not been served with any notice or order from an administrative or judicial body.

'This situation has pitched the Plaintiff's business associates/creditors against the Plaintiffs individually and collectively. 'The Plaintiffs have lost several business opportunities and incurred several liabilities while in Abuja owing to their not being given access to their funds in their accounts with the Defendants.

''The Plaintiffs have been put in a position by the Defendants where they cannot pay their staff salaries.

''The 3rd Plaintiff has been made to suffer hardship to the extent that he cannot take care of the needs of his immediate family and those of his aged parents who all depend and rely on him; the reason being that he has been deprived of the use of his legitimate funds with the Defendant.

*One of the 1st and 2nd Defendants' business associates committed suicide recently in Ebonyi State because of her funds that are tied down with the 1st and 2nd Plaintiffs owing to the action of the Defendant.

The plaintiffs are asking the court for: 'An Order directing the Defendants to, forthwith, grant them access to their respective accounts

'A Declaration that the Defendant is in breach of its contracts with the Plaintiffs.

Justice Jamil Y, Tukur will hear the two cases today.
