Imo 2015: Plot To Stop Iheanacho's Governorship Bid Flops

The plot by opponents of the immediate past minister of Interior, Capt. Emmanuel Iheanacho to stop his expected emergence as the governorship candidate of the All Progressives Grand Alliance (APGA) in Imo state with a 'black market' court injunction has flopped as Etiti High court declined from granting the prayers of one Kenedy Onyemara.

Investigations revealed that those behind the ploy had engaged the said one Kennedy Onyemara who has been discovered not to be a member of APGA in Atonarim Ward of Ihitte-Uboma LGA as claimed in a deposed affidavit backing his claims to seek an order of perpetual injunction to restrain Capt. Emmanuel Iheanacho from presenting himself to the screening panel ahead of the party gubernatorial primaries.

Onyemara, through his counsel, Ukpai Ukairo Esq, an Aba-based lawyer, unsuccessfully sought to stop APGA, the 1st Defendant from screening Capt. Iheanacho on the grounds that the former minister is not lawfully registered member of the party.

But unknown to Onyemara and his counsel, an Owerri-based lawyer, Barr. Amadi Obi stormed the court same day praying for the dismissal of the suit as it was not within its jurisdiction to determine.

Obi further prayed that the issue of who should be a candidate of a political party is not justiciable as the suit could simply viewed as a ploy hatched to stop Iheanacho from being the candidate of APGA. He maintained that the decision of who becomes a candidate remains the exclusive preserve and domestic affair of a political party and not the law court.

The presiding judge, Justice E. O Agada in his ruling restrained the parties from doing anything that will destroy or prejudice the subject matter of this suit till the interim injunction application is disposed of.

He also ordered that the 1st Defendant (APGA) be served at its Abuja head office while the 2nd Defendant (Capt. Emmanuel Iheanacho) by substituted means. The matter was however adjourned to the 25th Day of November 2014.

Meanwhile, a group known as Imo Progressives and Consultative Assembly (IPCA) has fingered a governorship aspirant, Mr. Okey Ezeh as the mastermind behind the purported back-door injunction and conspiracy to stop Capt. Emmanuel Iheanacho from emerging the governorship candidate of the All Progressives Grand Alliance (APGA).

The group's position which is contained in a statement signed by Nze Benjamin Irohah and Comrade Benjamin Ogoke, Coordinator and secretary of IPCA respectively and made available to newsmen in Owerri, described Ezeh's recent activities as driven by his desperation to emerge gubernatorial flag-bearer of APGA as satanic and humanly unimaginable.

The statement reads “We are surprise that Mr. Okey Ezeh, a governorship aspirant of the All Progressives Grand Alliance (APGA) has continued to corroborate with some external forces to destabilize and possibly deny Imo APGA from reclaiming the government house come 2015.

While the leadership of APGA is seriously planning to reclaim the governorship seat of Imo state which the party convincingly won in 2015, this fellow called Okey Ezeh is busy somewhere plotting to destroy and cause collateral damage to the party.

Recall that it was this same Okey Ezeh who mobilized some Imo APGA officials to Abuja with a petition purporting to sack the state chairman, Barr. Peter Ezeobi and subsequently disqualify the former minister of Interior, Capt. Iheanacho. It was while returning to Owerri by road that their vehicle unfortunately got crashed in a ghastly accident. The bodies of the five deceased persons are still lying stone-cold in the morgue while those that survived are recuperating in the intensive units of the hospitals.

Yet, after remotely causing the death of these party officials, this desperate and relatively unknown Mbaise-born politician has now conscripted another Mbaise-born High Court judge to create more problems for Imo APGA with black market injunction.

While we advise Okey Ezeh to beat a retreat on his governorship aspiration as a mark of respect for the death of these innocent party officials who died pursing his inordinate ambition, we on the other hand wish to remind the Lordship, Honourable Justice E. O Agada the need to uphold the sanctity of that temple of justice.

Our learned judge knows better than ever other persons that the issue of nomination of candidates for elective positions is determined by the rules and constitution of the party as such remains clearly a domestic issue which is not justiciable in a court of law.

Any further attempt to subvert justice or turn Etiti High court as a black market will definitely compel us to exploit the option of approaching the National Judicial Council (NJC).”
